US Court Orders Freedom of Abrego Garcia from ICE Custody

A court has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment is without legal authority.

"Since his release after erroneous detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her ruling.

The case stems from a erroneous deportation to El Salvador earlier this year, which US authorities later acknowledged was an mistake. Following his repatriation to the United States to answer human smuggling allegations, he was detained in immigration custody.

In her order, the court noted that the authorities does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."

Context of the Legal Challenge

The legal challenge center on conflicting assertions. Whereas the former administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically disputes this allegation.
